ROMANIA – 2014 Quotas Announced; Short Stay Visits for Schengen Visa Holders Facilitated

Romania’s work permit quotas for 2014 have been published in the Official Gazette (issue 791 on 17 December 2013), according to Government Decision 992/2013. Additionally, Romania has passed new legislation that allows short stay visits without the need for an additional visa for travellers who already hold valid multiple-entry visas or residence permits for the Schengen area.

More About Romania’s Work Permit Quotas

Romania’s work permit quotas run from 1 January every year and are decided annually by the government, based on the proposals from the Ministry of Labour. The quotas are set at national level and then subdivided into categories for local hires, assignees, highly skilled workers (Blue Cards) as well as seasonal workers, athletes, cross border workers, internships and volunteers. Once the quotas have been exhausted for a particular category, no more work permit approvals in that category can be given till the following year - unless the Romanian government exceptionally adjusts the quotas (this happened in 2012, but not in 2013).

Work Permit Quotas for 2014

The quotas for 2014 are the same as for 2013, and are as follows:

  1. work authorizations for local hires: 3000
  2. work authorizations for assignees: 900
  3. work authorizations for highly skilled workers (Blue Cards): 800
  4. work authorizations for seasonal workers: 100
  5. nominal work authorizations: 100
  6. work authorizations for interns: 200
  7. work authorizations for athletes: 300
  8. work authorizations for cross border workers: 100

Short Stay Visits for Schengen Visa Holders

The Romanian government has also passed new legislation (Emergency Ordinance no. 109/2013 completing the Government Emergency Ordinance no. 194/2002 on the regime of aliens in Romania, published in the Official Gazette of Romania, Part I, no. 796 of 17 December 2013) which, from 1 February 2014, will facilitate short term visits to Romania for foreign nationals who hold valid multiple entry visas or residence permits for a country in the Schengen area.

What is the Schengen Area?

The Schengen area is a borderless zone in Europe, comprising 26 countries (all EU member states apart from the UK, Ireland, Cyprus, Romania, Bulgaria and Croatia, but including Switzerland, Norway, Iceland and Lichtenstein).

Travellers holding valid visas or residence permits for one Schengen member state can use those visa or permits to travel for short term visitors (for up to 90 days out of any period of 180 days) during the validity of the visa. Note that the short term visits must be restricted to visits for tourism or business – work would not typically be permitted, unless other exemptions apply.

Romania’s New Legislation

Romania’s new legislation makes it possible for holders of either double or multiple entry visas, or residence permits, for a Schengen member state to travel without the need for an additional visa to Romania, provided that he visa or residence permit for the other Schengen member state is valid.

This is despite the fact that Romania is not yet a member of the Schengen area (Romania’s application to become a member is still under review).
